These Terms of Service govern the property management, sales, investment, lifestyle and guest services Pearl Property Phuket provides to clients. The specific scope of any engagement is set out in your individual service agreement; these Terms apply alongside it. Website use is governed by our Terms of Use.
1. About us
Services are provided by Pearl Property Phuket, registered in Thailand. Our registered office is 33/60 Moo 6, Kamala, Kathu, Phuket.
2. Services
Pearl provides:
- Property Management — full-service management of villas, condominiums and rental homes
- Property Sales — buyer-side and seller-side representation
- Investment Advisory — sourcing, market analysis and acquisition support
- Lifestyle and Concierge — guest experiences, tours, vehicle rentals and onsite services
- Holiday and Long-Term Rentals — short-term, mid-term and long-term tenancy arrangements
The specific scope of services for any client is set out in the relevant service agreement (a Management Agreement, Buyer Engagement Letter, Listing Agreement, Rental Booking Confirmation, or similar).
3. Engagement and contracts
A binding engagement with Pearl is created when you sign or otherwise accept the relevant service agreement. These Terms of Service form part of every engagement.
If there is any conflict between these Terms and your signed service agreement, the signed service agreement prevails.
4. Fees and payment
Fees are set out in your service agreement. Unless otherwise agreed:
- Management fees and commissions are charged in line with the agreed structure
- Owner payouts are made monthly, in line with the owner statement
- Repairs, replacements and vendor work are itemised at cost
- Property care, marketing, photography and listings are included in your management fee unless stated otherwise
- Guest deposits, damage deposits and refunds are handled per the booking confirmation
Charges are made in Thai Baht (THB) unless stated otherwise. Where currency conversion is involved, this is documented in your statement.
5. Client responsibilities
To allow Pearl to provide its services, the client agrees to:
- Provide accurate information about the property, ownership structure and any existing arrangements
- Hold and maintain appropriate property and public liability insurance
- Comply with all applicable laws, including building rules, juristic office requirements, rental restrictions, AML/KYC obligations and tax obligations
- Approve expenses above the agreed threshold within a reasonable time
- Communicate any changes affecting the engagement promptly
6. Pearl’s responsibilities
Pearl will:
- Provide services with reasonable skill, care and diligence
- Use trusted local vendors and partners and supervise their work
- Provide transparent monthly statements and clear communication
- Hold client funds in line with our internal procedures
- Notify the client promptly of emergencies, significant issues and any changes to scope
7. Bookings and guests
Where Pearl manages bookings on the client’s behalf:
- Bookings made through third-party platforms (Airbnb, Booking.com, Agoda etc.) are subject to those platforms’ own terms
- Guest deposits, cancellation policies and damage handling are processed in line with the booking confirmation and platform rules
- Pearl will use reasonable efforts to screen guests but cannot guarantee guest behaviour
8. Owner protection programmes
For qualifying properties, Pearl offers owner protection programmes including the Payment Protection Promise. Eligibility, scope and conditions are set out in the relevant Programme Terms, which form part of the service agreement.
9. Termination
Either party may terminate a service agreement on 60 days’ written notice, unless a different period is specified in the signed agreement.
On termination, both parties will cooperate to:
- Hand over keys, access, vendor relationships and documentation
- Complete any forward bookings as far as possible
- Settle outstanding fees, expenses and owner balances
Pearl may suspend or terminate services with shorter notice for material breach, insolvency, or unlawful activity.
10. Limitation of liability
To the maximum extent permitted by law:
- Pearl is not liable for indirect, consequential, special or punitive losses
- Pearl’s total aggregate liability to any client in any 12-month period is limited to the fees paid by that client to Pearl in that same period
- Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be limited by Thai law
11. Force majeure
Neither party is liable for failure to perform caused by events outside its reasonable control, including natural disasters, pandemics, government action, civil unrest or utility failures.
12. Governing law and disputes
These Terms and any service agreement are governed by the laws of the Kingdom of Thailand. The parties will use good-faith efforts to resolve any dispute through discussion; if not resolved, the Thai courts have exclusive jurisdiction.
13. Changes
We may update these Terms from time to time. Material changes will be notified to active clients in writing.
